Advanced Utility Solutions (“AUS,” “we,” “our,” or “us”) provides flagging, traffic control, security, event staffing, and related services with a commitment to professionalism and safety. By using our website or engaging our services, you acknowledge and agree to the following:

1. No Guarantee of Uninterrupted Service
AUS will make reasonable efforts to provide services as scheduled, but we are not responsible for delays, interruptions, or changes caused by weather, traffic, road closures, emergencies, acts of God, labor shortages, equipment failure, governmental actions, or any circumstances beyond our direct control.

2. Client Responsibility for Site Conditions
Clients are solely responsible for ensuring that any worksite, event space, roadway, or surrounding environment is safe, legally compliant, and suitable for AUS personnel and operations. AUS may refuse or discontinue services if conditions are unsafe, non-compliant, or materially different from what was disclosed at the time of scheduling.

3. No Assumption of Client Duties
AUS traffic control, flagging, and security personnel do not replace the client’s legal obligations regarding jobsite safety, OSHA requirements, DOT compliance, municipal permits, or event safety planning. AUS services supplement—but do not assume—the client’s regulatory or operational responsibilities.

4. Limitation of Liability
To the fullest extent permitted under New York law:
• AUS is not liable for indirect, incidental, consequential, or punitive damages, including property damage, lost income, delays, or reputational loss.
• AUS’s total liability for any claim, whether arising in contract, tort, negligence, or otherwise, shall not exceed the amount paid by the client for the specific service giving rise to the claim.
• AUS is not responsible for damages resulting from inaccurate instructions, client negligence, unauthorized alterations to traffic setups, interference by third parties, or hazards outside our control.

5. No Guarantee of Public Behavior or Third-Party Actions
AUS cannot control the conduct of drivers, pedestrians, attendees, or members of the public. Clients acknowledge that public behavior, crowd dynamics, and vehicle actions are unpredictable and may create risk even when proper traffic control measures are in place.

6. Equipment Disclaimer
All cones, signs, barricades, devices, and equipment deployed by AUS remain the property of AUS unless otherwise agreed in writing. AUS is not responsible for theft, loss, or damage caused by third parties or site conditions outside our control.

7. Website Information Disclaimer
All information on this website is provided for general informational purposes only. AUS makes no warranties—express or implied—regarding accuracy, completeness, or suitability. Service availability may vary based on time, location, and conditions.

8. Legal Compliance
